ATO FOCUS ON LAFHA COULD IMPACT 457 VISAS

Living Away From Home Allowance (LAFHA) is the delivery of funds from the Australian Taxation Office (ATO) through an employer when a staff member is required to travel away from their usual residence on business for an extended amount of time and to support there need to cover the expenses incurred as a result of being relocated for their work.

Individuals employed on contracts that require fly-in fly-out (FIFO) arrangements were able to receive the benefits, as were officials transferred to remote postings.

In some cases, temporary residents in Australia - such as those on the 457 visa - were technically considered to be living far from their permanent residence for work purposes and as such were eligible to receive the LAFHA.

However, the changes proposed by the ATO could see these payments come to an end as the taxation office seeks to better regulate these concession payments.

It aims to limit the availability of LAFHA payments to those immigration visa holders who have an established home in Australia and are living and working away from this location.

For international workers planning on travelling to Australia for employment, this could give them a reason to re-evaluate their circumstances and consider the prospects offered by a more permanent visa solution.

This is especially true for those migrants who are planning on entering the mining and resources sector - which is well known for its reliance on FIFO arrangements - as they may need to review their living arrangements in advance.

Olympic Dam project to inject $8.6bn into South Australia

BHP Bilton approved for significant expansion of its existing mining and processing operation at Olympic Dam in northern Adelaide.

The ore body at Olympic Dam is the world’s fourth largest copper resource largest know deposit of uranium and rich deposits of gold and silver

Constructing the various elements of the proposed expansion would require a construction workforce averaging 4,000 with a peak of 6,000 people until full production is reached.

Long term a doubling up of the existing operational workforce to 8,000 is expected and estimated that an additional 15,000 jobs would be created in South Australia to support this expansion.

With Australia’s population growth driven largely by overseas immigration, this represents a great opportunity for skilled construction workers to migrate into the Lucky Country, either temporarily or permanently.

General Skilled Migration – Skillselect

From the 1 July 2012 a new program called The Skilled Migrant Selection Register (SkillSelect) will be introduced .
SkillSelect will build upon and draw together the suite of skilled migration reforms introduced over the past three years and will ensure the selection of the best and brightest skilled migrants from a pool of intending migrants.

SkillSelect is an electronic system based upon a two-stage process. Intending migrants will first submit claims for skilled migration by an online EOI and subsequently be invited to make a visa application if they have the skills and qualifications needed in the Australian labour market.
An EOI is an online expression of interest for skilled migration to Australia. It is how intending migrants register their interest in applying for a skilled visa.
Intending migrants will provide basic biographical and other information such as occupation, details of work experience and level of English language ability on the online EOI form. Those expressing interest in independent, family sponsored, state or territory sponsored and/or business skills migration would need to submit their claims against the relevant points test.
Intending migrants submitting an EOI are able to indicate which migration programs they are interested in. A prospective applicant may register interest in one or more visa program depending on their eligibility and personal preferences.
Selected EOIs are invited to lodge an application. Intending migrants may be selected by the department for Independent or Family sponsored migration; or state or territory government agencies for state sponsored migration, business skills migration or a state sponsored regional provisional visa. Alternatively, employers may contact intending migrants to arrange sponsorship for permanent employer sponsored migration or a subclass 457 visa.
If invited to apply for a visa the intending migrant must either be outside Australia, or be lawfully in Australia to make a valid application. It is proposed that you would be required to lodge your visa application within 60 days of the date of invitation.

New migration measures - mining boom success
Australia is currently benefitting from a mining boom – that is, there is a huge demand for its raw mineral exports.
This is not just good news for those in the mining and raw materials industries, who can pick and choose from the hundreds of job vacancies; it’s also having a knock-on effect in the construction industry. Construction contracts with the mining industry have almost doubled in value since last year. The hottest demand is for construction workers with experience in oil and gas.
The Australian Bureau of Statistics predicts that the 200,000 people currently employed in Australia’s mining industry is set to increase to 300,000 by 2015 – with 60,000 of these being construction jobs.
Western Australia and Queensland are the epicentres of the boom. In Queensland, there’s such a serious shortage of construction skills that the industry is struggling to keep pace. Queensland needs 38,000 jobs in the sector filled by 2014.
With Australia’s population growth driven largely by overseas immigration, this represents a great opportunity for skilled construction workers to migrate into the Lucky Country, either temporarily or permanently.
